Iran's system of constitutional rights, which is based on the idea of "valie faqih" (the guardianship of the Islamic jurist), discusses the scope of the authority of rulers, in its constitution, and especially the authority of valie faqih, and this has caused the diversity of opinions among scholars. Ayatollah Misbah Yazdi is one of the scholars who discussed the scope of the authority of valie faqih, and thus, the main question of this article is, what are the authorities of valie faqih based on the principles of the constitution in his opinion? This research has tried to answer this question using a descriptive-analytical method. According to the results of this research, the scope of valie faqih’s authority is absolute in jurisprudential matters, as Ayatollah Misbah Yazdi believes, and is within the framework of Sharia laws and commands; but from a legal point of view, it is not limited to the principles of the Constitution, considering Article 57, and goes beyond Article 110. قلمرو اختیارات زمامداران از جمله کلیدی ترین مباحث در نظام های حقوق اساسی است که در قانون اساسی هر کشوری منعکس شده و با نگاه به مبانی تشکیل آن نظام حقوقی فهمیده می شود. نظام حقوق اساسی ایران که بر پایه اندیشه «ولایت فقیه» بنیان نهاده شده، در قانون اساسی خویش به تنظیم گستره اختیارات حاکمان و در رأس آن، ولی فقیه پرداخته و همین موجب تنوع آراء در میان اندیشمندان گردیده است. آیت الله مصباح یزدی از جمله اندیشمندانی است که درباره گستره اختیارات ولی فقیه به اظهارنظر پرداخته و به همین سبب، پرسش اصلی مقاله این است که اختیارات ولی فقیه در اندیشه ایشان با تکیه بر اصول قانون اساسی چیست؟ پژوهش حاضر کوشیده است با روش توصیفی ـ تحلیلی به این پرسش پاسخ دهد. یافته های پژوهش نشان می دهد که از نگاه آیت الله مصباح یزدی، قلمرو اختیارات ولایت فقیه از جهت فقهی، مطلق بوده و در چارچوب قوانین و احکام شرعی است و از نگاه حقوقی با عنایت به اصل 57، محدود به اصول قانون اساسی نیست و فراتر از اصل 110 قانون اساسی تلقی می شود. https://hoghoughi.nashriyat.ir/sites/hoghoughi.nashriyat.ir/files/1402-10/2.pdf
