abstract = {According to the Islamic thought, the right of sovereignty belongs to God, and granting this privilege to any person should be be done by Himself; while according to the common political philosophy, this right comes from the people themselves, and the rulers are merely their representatives, and the government is formed by their presence and acceptance. Stating the irreplaceable position and the main role of people in realization of the Islamic system, Ayatollah Misbah Yazdi emphasizes that the two categories of legitimacy and acceptability are separated in the essence of the Islamic government. He believes the government’s legitimacy comes from God and people have no role in it, but the practical implementation of the government is not possible without the acceptance of the people of the society, and if there is no acceptability among the people, no government can be efficient. Concentrating on the views of the prominent contemporary philosopher and thinker, Allameh Misbah Yazdi, this article tries to explain and analyze his political and legal viewpoint regarding the criterion of legitimacy and the pillar of realization and efficiency of government in Islam, using a descriptive-analytical method. We have explained Allameh’s idea in this article by referring to his works.},

abstract_fa ={در اندیشه اسلامى، حق حاکمیت از آن خداوند است و اعطای این امتیاز به هر شخص باید از ناحیه او باشد، در حالی  که براساس فلسفه سیاسى رایج، این حق از خود مردم ناشى مى شود و حاکمان صرفاً نمایندگان مردم هستند و این حکومت از طریق حضور مردم و پذیرش آنها شکل می گیرد. آیت الله مصباح یزدی ضمن تصریح بر جایگاه بى بدیل و نقش اصلی مردم در تحقق نظام اسلامی، بر تفکیک دو مقوله «مشروعیت» و «مقبولیت» در ماهیت حکومت اسلامی تأکید دارد. در نگاه ایشان، مشروعیت حاکمیت ریشه در ذات مقدس خداوند دارد و مردم در ایجاد آن نقشی ندارند؛ اما تحقق عملی حکومت بدون پذیرش افراد جامعه امکان پذیر نخواهد بود و بدون مقبولیت مردمی هیچ حکومتی نمی تواند به صورت کارامد به منصه ظهور برسد. پژوهش حاضر با محوریت دیدگاه  های فیلسوف و اندیشمند برجسته معاصر علامه مصباح یزدی، درصدد است با روش توصیفی ـ تحلیلی، دیدگاه سیاسی و حقوقی ایشان درخصوص ملاک مشروعیت و رکن تحقق و کارامدی حکومت در اسلام را تبیین نماید. این نوشتار کوشیده است دیدگاه ایشان را با استناد به آثار ایشان تشریح کند.},
