If it formulates laws without regard to ethical principles, it can lead to injustice, discrimination, and violations of the human rights of individuals in society. On the other hand, legislators, who are professionals who observe "professional ethics standards", must also observe the specific ethical standards of their profession in the process of lawmaking, especially since in this position, situations such as the use of authority and power, guaranteeing the rights of citizens, loyalty to the state, maintaining secrets, paying attention to the privacy and human dignity of individuals, etc., confront them with ethical challenges. In this article, in the process of legislation and providing a framework for formulating fair and ethical laws, criteria such as: the independence of the legislator, the morality of the legal literature and the legislator, anti-corruption, ethical supervision of legal enactments, the rule of law, perfectionism, justice, human rights and citizenship, transparency and accountability, balance of individual rights and public interests, transparency of the law, minimizing criminal law, morality of evidence to prove a claim, and finally, religiosity, have been examined. «قانون‌گذاری» به عنوان حرفه‌ای که قواعد و ضوابط قانونی دیگر حرفه‌ها را تدوین می کند، نقش تعیین کننده ای در شکل دهی به ساختارهای اجتماعی، اقتصادی و سیاسی جامعه دارد، اگر به تدوین قوانین بدون توجه به اصول اخلاقی بپردازد میتواند به بی عدالتی، تبعیض و نقض حقوق انسانی افراد در جامعه منجر شود. از سوی دیگر قانون‌گذاران که از اصحاب حرفه‌ها وقع ملاحظة «معیارهای اخلاق حرفه ای» را دارند، خود نیز باید در فرایند حرفة قانون‌گذاری، ضوابط خاص اخلاقی حرفه خود را مراعات کنند؛ خصوصا که در این منصب وضعیت‌هایی مانند استفاده از اختیارات و قدرت، تضمین حقوق شهروندان، وفاداری به حاکمیت، حفظ اسرار، توجه به حریم خصوصی و کرامت انسانی اشخاص و... آنان را با چالش های اخلاقی مواجه می‌سازد. در این نوشتار، در فرآیند قانونگذاری و ارائه چارچوبی برای تدوین قوانین عادلانه و اخلاقی، معیارهایی همچون استقلال قانون گذار، اخلاقی بودن ادبیات قانون و قانونگذار، فساد ستیزی، نظارت اخلاقی بر مصوبات قانونی، حاکمیت قانون، کمال محوری، عدالت محوری، حقوق بشر و شهروندی، شفافیت و پاسخگویی، توازن حقوق فرد و منافع عمومی ، شفافیت قانون، حداقلی سازی حقوق کیفری، اخلاقی بودن ادلة اثبات دعوا، و در نهایت، دینمداری، مورد بررسی قرار گرفته است.
