However, this right is not absolute and is subject to restrictions when it conflicts with the public interest, social order, and fundamental values of society.One of the most important areas of restriction on freedom of expression is the issue of incitement to crime, where an individual's spoken or written expression can lead to the commission of criminal behavior by others. This research, using the opinions of Islamic jurists and lawyers and related documents, seeks to explain the concept of incitement to crime as one of the limitations of freedom of expression from the perspective of Islamic jurisprudence and law, using a library study method, and the necessary information has been collected, analyzed, and analyzed; therefore, the research method in this article is considered descriptive-analytical. Freedom of expression is one of the important human rights issues that has been addressed in Islamic jurisprudential texts. From the perspective of Islamic law, freedom of expression has limitations, including the prohibition of incitement to crime, which has been explained by citing verses and narrations, the foundation of reason, the necessity and necessity of security in society, and the rule of non-harm, etc. آزادی بیان به عنوان یکی از حقوق بنیادین بشر، در فقه و حقوق اسلامی جایگاهی ویژه دارد. با این حال، این حق مطلق نبوده و در تعارض با مصالح عمومی، نظم اجتماعی و ارزش‌های بنیادین جامعه، با محدودیت‌هایی همراه می‌شود. یکی از مهم‌ترین عرصه‌های محدودیت آزادی بیان، مساله تحریک به جرم است؛ جایی که بیان گفتاری یا نوشتاری فرد می‌تواند زمینه‌ساز ارتکاب رفتار مجرمانه توسط دیگران شود. این پژوهش با استفاده از آرای فقها و حقوقدانان اسلامی و مستندات مرتبط با آن در صدد تبیین مفهوم تحریک به جرم بعنوان یکی از محدودیت های آزادی بیان از نظر فقه و حقوق اسلامی به روش مطالعه کتابخانه ای انجام گرفته و اطلاعات لازم جمع آوری وتجزیه و تحلیل شده است؛ بنابراین روش تحقیق در این مقاله، توصیفی- تحلیلی محسوب می شود. آزادی بیان از مسائل مهم حقوق بشری است که در متون فقهی اسلام، به آن پرداخته است و از نظر حقوق اسلامی آزادی بیان دارای محدودیت های است که از جمله؛ ممنوعیت تحریک به جرم است که با استناد به آیات و روایات، بنای عقلا، لزوم و ضرورت امنيت در جامعه و قاعده لاضرر و ...... تبیین شده است.
