The common causes in both systems include: the death or interdiction (ḥajr) of the principal (muwakkil) or the agent (wakīl), the disappearance of the subject matter of the agency, and the expiration of its term. However, there are also fundamental differences. In Imāmī jurisprudence and Iranian law, the dismissal of the agent is effected solely by the will of the principal; whereas in Hanafi jurisprudence and Afghan law, this is conditional upon the agency not being linked to the right of a third party. The resignation of the agent is likewise subject to this same condition in the Hanafi system, but no such condition exists in Imāmī jurisprudence. Regarding interdiction, Hanafi jurisprudence primarily considers permanent insanity as valid and disregards cases such as a coma, whereas Imāmī jurisprudence encompasses all types of interdiction. The death of the principal or the agent in Hanafi jurisprudence is conditional upon there being no right of a third party; however, in Imāmī jurisprudence, it causes immediate termination without any condition. By identifying the commonalities and differences, this comparative study provides an analytical framework for understanding the rules governing the termination of agency.}, keywords = {agency, Termination of Agency, Conditions Stipulated within Contracts, Irrevocable Agency, delegation, }, title_fa = {بررسی انحلال وکالت در قانون مدنی ایران، افغانستان، فقه جعفری و حنفی}, abstract_fa ={پژوهش حاضر به بررسی تطبیقی اسباب انحلال وکالت در فقه امامیه و حقوق ایران با فقه حنفی و حقوق افغانستان می‌پردازد. اسباب مشترک در هر دو نظام عبارت‌اند از: فوت یا حجر موکل و وکیل، زوال موضوع وکالت و انقضای مدت، اما تفاوت‌های اساسی نیز وجود دارد. در فقه امامیه و حقوق ایران، عزل وکیل تنها با ارادة موکل محقق می‌شود؛ درحالی‌که در فقه حنفی و حقوق افغانستان این امر مشروط به عدم تعلق حق شخص ثالث به وکالت است. استعفای وکیل نیز در نظام حنفی مشروط به همین قید است، اما در امامیه چنین شرطی ندارد. در بحث حجر، فقه حنفی عمدتاً جنون دائم را معتبر می‌داند و مواردی مانند اغما را نادیده می‌گیرد، اما فقه امامیه تمام انواع حجر را شامل می‌داند. فوت موکل یا وکیل در فقه حنفی مشروط به عدم تعلق حق ثالث است، ولی در امامیه بدون قید موجب انحلال فوری می‌گردد. این مطالعة تطبیقی با شناسایی اشتراکات و افتراقات، چارچوبی تحلیلی برای درک احکام انحلال وکالت ارائه می‌دهد.}, keywords_fa = {وکالت ,انحلال وکالت ,شروط ضمن عقد ,وکالت بلاعزل ,تفویض ,}, url = {https://hoghoughi.nashriyat.ir/node/5003124}, eprint = {https://hoghoughi.nashriyat.ir/sites/hoghoughi.nashriyat.ir/files/article-files/5003124-1788595457.pdf} }
