With the expansion of organizational obligations and contemporary legal institutions, the necessity of re-reading and adapting this rule to new legal systems is increasingly felt. This research, employing a descriptive-analytical method and library studies, examines the Quranic and narrational (ḥadīth) evidence of the rule of al-Zaʿīm Ghārim. It further investigates the position of this rule in interpreting organizational obligations and institutional legal relations by utilizing the views of Imāmīyyah jurists and making a comparative analysis with Sunni jurisprudence (Fiqh ʿĀmmah) and comparative law. The results indicate that this rule can provide an efficient theoretical framework for analyzing modern obligations such as bank guarantees, liability insurance, and organizational contracts. Additionally, its adaptation to other legal systems demonstrates the rule's capacity for accommodation and localization within contemporary law. قاعدۀ «الزعیم غارم» یکی از اصول اساسی فقه اسلامی است که التزام ضامن به ایفای تعهدات مضمون‌عنه را مورد تأکید قرار می‌دهد و نقش مهمی در تبیین مسئولیت‌های شرعی و حقوقی ایفا می‌کند. با گسترش تعهدات سازمانی و نهادهای حقوقی معاصر، ضرورت بازخوانی و تطبیق این قاعده با نظام‌های حقوقی جدید بیش از پیش احساس می‌شود. این پژوهش با روش توصیفی ـ تحلیلی و مطالعات کتابخانه‌ای، مستندات قرآنی و روایی قاعدۀ الزعیم غارم را واکاوی کرده و با استفاده از دیدگاه فقهای امامیه و مقایسۀ تطبیقی با فقه عامه و حقوق تطبیقی، جایگاه این قاعده در تفسیر تعهدات سازمانی و روابط حقوقی نهادی را بررسی نموده است. نتایج حاکی از آن است که این قاعده می‌تواند چارچوب نظری کارآمدی برای تحلیل تعهدات مدرن همچون ضمانت‌نامه‌های بانکی، بیمۀ مسئولیت و قراردادهای سازمانی فراهم آورد. همچنین تطبیق آن با نظام‌های حقوقی دیگر نشان‌دهندۀ ظرفیت انطباق و بومی‌سازی قاعده با حقوق معاصر است. https://hoghoughi.nashriyat.ir/sites/hoghoughi.nashriyat.ir/files/article-files/5003923-1788595421.pdf
