    Examining the Ways of Committing Administrative and Economic Crimes in Iran and Ways to Deal with it

    Abstract: 
    Nowadays, administrative and economic crimes and violations in developing countries, including Iran, are considered as one of the most important challenges and obstacles to the progress of society. This has caused administrative and economic crimes to be investigated and studied side by side due to the closeness of the subject and even the basis. One of the special and unique features of the mentioned crimes is that the perpetrators have high resources and positions. Also, the perpetrators of these types of crimes have apparently justified reasons for their actions by using legal loopholes, and the fact that there is rarely evidence of their actions has made this category of crimes more complicated. Since in the current laws and regulations of the country, there is no specific definition of administrative and economic crimes, as well as the terms and conditions of their criminal responsibility, The current research with a descriptive-analytical approach seeks to prove that the legal policy of the country in the field of administrative justice and criminal justice should be based on the explanation, definition and analysis of the ways of committing administrative and economic crimes and predicting the guarantee of executions and mechanisms to deal with it, while also paying attention to Preventive and persistent aspects of this category of crimes should be included to ensure public interest. Therefore, in order to take advantage of the legal capacities and eliminate the legal gaps in this field, some suggestions are provided.

    Title :بررسی شیوه‌های ارتکاب جرایم اداری و اقتصادی در ایران و راهکارهای مقابله با آن
    Abstract: 
    امروزه جرایم و تخلفات اداری و اقتصادی در کشورهای در حال توسعه از جمله ایران به‎عنوان یکی از مهم‎ترین چالش‎ها و موانع پیشرفت جامعه مطرح می‎شود. همین امر سبب شده است که جرایم اداری و اقتصادی به دلیل قرابت موضوعی و حتی مبنایی در کنار یکدیگر مورد بررسی و مداقه قرار بگیرند. یکی از ویژگی‌های خاص و منحصر به فرد جرایم مذکور، برخورداری مرتکبان آن از منابع و موقعیت‌های بالا است. از آنجایی‎که در قوانین و مقررات کنونی کشور، تعریف مشخصی از جرایم اداری و اقتصادی و نیز ضوابط و شرایط مسئولیت مجرمانه آنها نشده است، پژوهش حاضر با رویکردی توصیفی-تحلیلی در پی اثبات این است که سیاست حقوقی کشور در حوزه عدالت اداری و عدالت کیفری باید مبتنی بر تبیین، تعریف و تحلیل شیوه‌های ارتکاب جرایم اداری و اقتصادی و پیش‌بینی ضمانت اجراها و سازوکارهای مقابله با آن ضمن توجه توأمان به جنبه‌های پیشگیرانه و پیگیرانه این دسته از جرایم قرار بگیرد تا منافع عمومی تضمین شود. لذا جهت بهره‌گیری از ظرفیت‌های حقوقی و رفع خلأهای قانونی در این حوزه، پیشنهاداتی ارایه می‎شود.
